Smart Surveillance and the Home ( The Case of Ring and Similar Technologies)
The rise of connected home devices have offered new form of convenience and access. However, they have brought notable challenges in their wake, The European Data Protection Board (EDPB) has noted the need to balance these conveniences with the fundamental rights to data protection, privacy and autonomy.
The complex reality of home devices which share information beyond the boundaries of the home has been raised as an issue for concern and exploration by the European Data Protection Board. Already under the 1995 Data Protection Directive which preceded GDPR the CJEU had ruled that the household exemption for data protection obligations must be narrowly construed where data isĀ shared beyond the home.
This research report by Joshua Hoshva and Daragh O Brien examines some of the fundamental issues with the domestic adoption of smart surveillance technologies, particularly in the context of how data protection law applies (or doesn’t apply) in a domestic use context.
